Tips on How to Handle Personal Injury Claims
Auto insurance is meant to protect you and your loved ones from financial ruin in the event that you or someone you love is involved in a car accident. Even so, you must not forget that insurance companies are a business by design and their main goal is to make a profit. To that end, insurance companies employ negotiation tactics to try and convince insureds to settle claims for the absolute minimum. This reality is even more true when it comes to filing an insurance claim with the opposing party’s insurance provider. In those instances, car insurance providers can make it extremely difficult to obtain full compensation for your injuries. As a personal injury law firm handling thousands of cases over the years, we have come to experience the countless methods insurers utilize to minimize personal injury settlements. That is why we think it is important to share with you some of the tips and tricks auto insurance companies don’t want you to know about personal injury claims. Here are three tips that can be helpful if you or someone you love filed an insurance claim after a car accident:
Don’t Accept Initial Settlement Offers: As we mentioned above, insurance companies are for profit businesses. When an adjuster contacts you about your claim, keep in mind that their bestcase scenario is for you to agree to settle your personal injury claim for the lowest amount possible. Essentially, the interests of the insurance company are at odds with injured claimants. After a car accident, you may see your medical bills, property damage, and vehicle repair expenses begin to escalate rather quickly. And for many clients, you may have an inability to work.
No Additional Compensation Can Be Obtained After Settlement: Adjusters usually don’t take the time to explain this point in detail during the settlement process. If and when you agree to settle your personal injury claim, you are likely forfeiting your right to pursue any additional litigation going forward. This means that if it turns out that your injuries will cost you a lot more than you had originally thought, you will be on the hook for any surgery or medical treatment that is required in order to recover from your injury. Remember, if a settlement has been reached in your case, you will have no further ability to recover additional compensation.
Insurers Prefer Settling Before Lawyers Get Involved: Fundamentally, auto insurers want to reduce costs and increase profits. When insurance companies are forced to retain a defense attorney in order to negotiate settlements or defend lawsuits, it increases costs and thus decreases profits. It is important to recognize this reality early in the claims process in order to get a personal injury claim resolved quickly and without further delay. For this reason, it is highly recommended to speak with a personal injury attorney prior to agreeing to any settlement. An experienced personal injury lawyer will be able to help simplify the personal injury process and help you get fully compensated for your injury without further delay. Simply states, hiring a personal injury lawyer increases your chances of receiving maximum compensation for your injuries.
