Proving Fault in Florida Traffic Accidents
A tort is a wrongful injury to a person or his or her property. For example, when you hurt a person or damage a person’s property these are considered torts. The person inflicting harm is called the tortfeasor. In other words, a civil as opposed to a criminal wrong, other than a breach of contract is a tort. Duty is the first element needed to prove negligence. Duty is an obligation for a person to meet a certain standard of care. Normally, the standard of care is a reasonable personal standard. Reasonable care is the minimum amount of care owed to others. A duty of reasonable care is owed when an injury to a person is foreseeable. Foreseeability refers to whether an injury to a plaintiff could have been anticipated. When a person’s conduct creates a foreseeable risk of harm to another, then a duty of reasonable care arises. If the tortfeasor does not exercise reasonable care, then the tortfeasor may be liable for negligence. Breach of duty is the second element of negligence. To be found negligent, the defendant must have also breached the duty he owed to the plaintiff. The beach or duty of duty is a failure to comply with a certain standard of care. The standard of care applied is usually reasonableness. What is considered reasonable care depends on the circumstances. When applying the reasonable person standard, ask whether a reasonable person under similar circumstances and with similar abilities to the defendant would have acted in the same manner as a defendant. The third element of negligence is causation. The defendants actions must be the cause of the plaintiff’s injury for the defendant to be found negligent. There are two components to causation in the defendant’s action. Essentially, the defendant’s action must be both the actual and proximate cause of the plaintiffs injuries. The tort law system compels the tortfeasor to compensate the injured party for his or her losses. This accountability factor is crucial to our legal sense of fairness and equity. People should be held responsible for their actions, especially when they injure others. A form of redress is crucial and should be available for all injured victims of carelessness, recklessness, or intentional injury. In conclusion, tort law allows private individuals to use the legal system to resolve disputes in which one party claims the other has acted improperly resulting in harm.
