A man died Sunday after a car crash on I-95 according to a spokesperson for the Florida Highway Patrol. The crash occurred after 2pm on Sunday September 20, 2020. The initial impact occurred when a man driving the vehicle involved in the crash was headed southbound on I-95 and bumped into a white van causing minimal damage. After hitting the white van, the man swerved and hit a row of trees in the median. The man’s vehicle overturned and landed upside down in a water filled ditch. FHP says one of the passengers in the man’s vehicle was airlifted to the nearest hospital and later died as a result of the injury sustained in the crash. There are no further details to report at this time as the cause of the crash is currently being investigated by the Florida Highway Patrol.
Most car accident victims face a greater risk of experiencing an insurable loss as a result of a car crash than any other type of insurable loss. In South Florida, we use cars to get around every day and while in use we drive at high rates of speed and find ourselves in close proximity to other drivers on roadways, streets, and highways all throughout South Florida. As a result, car accidents are expected and when they do occur, the risk for serious injuries and property damage are great. Auto insurance policies include both first-party coverages and third-party coverages. First party coverage covers property damage to your own car. Third party coverage covers property damage to another driver’s vehicle in addition to bodily injuries sustained by other drivers and passengers due to your negligence. Additionally, in some states (not Florida) uninsured or underinsured motorist coverage may be a requirement in a personal auto insurance liability policy. Uninsured or underinsured motorist coverage can be helpful for a driver who is in a car crash with another driver who is found to be at fault for the crash and does not have liability insurance or has very low coverage limits that are far below what is needed to cover your damages. Finally, in a limited number of jurisdictions, drivers must carry no-fault insurance policies. No-fault auto insurance is required in Florida as personal injury protection insurance or PIP. PIP is intended to speed up the resolution of smaller claims and to lessen the number of personal injury lawsuits arising from less serious car crashes. Although many injury victims understand that they have a right to bring a personal injury case against the party who caused their injury, they often don’t understand how the legal process works and feel overwhelmed with the claims process or the legal system. In some cases, the first step is to file an insurance claim with either your own auto insurer. In other cases, the first step is to file an insurance claim with the opposing party’s auto insurer. In both situations, the help of a skilled personal injury lawyer can be a great asset to have on your side.
