According to a spokesperson for the Miami-Dade Police Department, a woman driving a SUV lost control and drove over a sidewalk, smashed through bushes, and slammed into an ATM in the drive-thru area of a bank last Friday night. The woman also ran over a woman who was pinned underneath the SUV. Thankfully, Miami Beach Police and Miami-Dade Fire Rescue responded quickly and were able to extricate the woman under the SUV. The woman was eventually pulled out from under the SUV and airlifted to a nearby trauma center for emergency medical treatment. At this time, the names of the driver and victim have not been released as police officials are still conducting an investigation into the cause of the accident.
3 Important Steps to Take After an Accident
Locate Witnesses: Following a car accident, make sure that you or a trusted family member or friend gets the names, phone numbers and license plate numbers of any important witnesses and parties involved in the car accident. If you decide to file an insurance claim or lawsuit in the future, any lawyer you retain will appreciate the information and it will make it easier to locate witness identities to prevent the defense from disputing your liability claims.
Follow Your Doctor’s Advice: It is very important that you follow your doctor’s advice. Failure to do so can have serious adverse consequences on your medical health and can hurt your personal injury case or claim. From a litigation stance, understand that your failure to obtain continuous medical treatment necessary to treat your injury may create an opportunity for insurance defense attorneys and their experts to question your credibility and diminish the seriousness of your injuries. Laws are different from state to state but in most cases, states require car accident victims to obtain medical treatment within a narrow time window following a car accident in order to receive Personal Injury Protection (PIP) benefits to be paid for under your own policy. In Florida, you need to seek medical treatment within 14 days following a car accident and only from specified licensed professionals in order to access PIP Insurance benefits, under your own Florida auto insurance policy.
Hire a Car Accident Lawyer: It is quite rare for an auto insurance company to simply evaluate your damages and write you a check. Usually, this will only occur when liability is clear, the damages are substantial and the defendant’s insurance policy is small and you have minimal coverage. As such, one of the most important decisions you will have to make early in the personal injury claim process is who should represent you and be your legal advocate. It is important to hire an attorney with the background, experience and financial resources to competently and successfully prosecute your personal injury case and go head to head with the insurance defense attorneys.
