Accident on NW 41st Street Leaves Three Seriously Injured

The Miami-Dade police department is investigating a crash that occurred on June 20, 2019. The accident occurred when a Nissan Sedan heading south struck the wrong side of a Dodge sedan near Northwest 41st Street. The driver of the Dodge spun out of control and struck another vehicle, an SUV from the rear. MDPD says there were seven persons involved in the crash. Upon arrival, EMS reported that three people sustained serious while the other three only sustained minor injuries. The driver of the Dodge and the driver of the SUV with one of his passengers sustained serious injuries. The victims that sustained minor injuries including the driver of the Nissan were treated on the site of the accident. Meanwhile, others with serious injuries were transported to the nearest hospital. No further details were released. Car accidents can be really difficult to deal with but unfortunately accidents happen every day in South Florida In a personal injury case, you may be able to recover the following types of damages:

Damage to Your Vehicle: After a car accident, you are likely to take your vehicle to a repair shop where they will provide you with a repair estimate. After you submit the repair estimate to your insurance company, the insurance company usually sends out an adjuster to take a look at the car to help the insurer determine the amount necessary to repair your vehicle.

Car Rentals: If you need to rent a car while your vehicle is being repaired, you can seek repayment for this expense in your lawsuit against the at-fault driver.

Medical Expenses: Severe car accidents cause accident victims to accumulate up medical bills for a variety of treatments including, ambulance rides, emergency department visits, diagnostic scans, x-rays, surgery, aftercare, and prescription medications.

Future Medical Expenses: Severe injuries can cause patients to require weeks, months, or even years to obtain a full recovery. Accident victims might need additional surgeries, follow-up, care or other treatment well after a settlement is agreed upon in their case. Future medical treatment also includes long-term care for catastrophic injuries or lifelong treatment for a chronic condition caused by an accident.

Rehabilitative services: Severe injuries often can cause patients to require weeks, months, or even years of physical therapy to gain back all of their functions—if they are able to make a full recovery. The court might compensate a victim for expected physical therapy as well as any assistive devices needed to function. Examples of assistive devices include wheelchairs, canes, walkers, and prosthetic limbs.

Lost wages: Depending on the seriousness of a car accident, an injured person might miss days, weeks, or even months of work. Although employee sick leave and PIP insurance will cover wages for a short period of time, extended leaves results in additional lost wages. Even when an injured car accident victim returns to work, doctors might limit hours or activities, making it take longer to return to full-time pre-accident status. As a result, full-time and part time employees typically include lost wages in car accident claims.

Lost earning capacity: Much like future medical costs, extensive recovery might cause an injured person to miss work beyond the trial date. In a personal injury action, an injured plaintiff is entitled to claim damages for lost earning capacity, past and future, proximately caused by the injury, where such damages are established to a reasonable degree of probability and are not speculative. Lost earning capacity especially factors into car accident injuries resulting in permanent disability. Catastrophic injuries cause disabilities preventing injured persons from returning to work, or requiring a change of career, which might force a reduction in salary.

Pain and suffering: Injury accident claims often include requests for compensation for pain and suffering when severe injuries have occurred. Damages for pain and suffering are awarded for the physical and mental suffering that accompany an injury. This includes tangible physical pain as well as the mental anguish as a result of a reduced quality of life and dealing with a serious injury.

Loss of consortium: Catastrophic car accidents can wreak havoc on marital relationships by driving a physical and emotional wedge between spouses. Car accident injury victims whose marriage suffers from their injuries can sue for loss of consortium with a spouse.

Scarring and disfigurement: Another type of non-economic loss from car accident claims includes the humiliation, embarrassment, and anger stemming from scars and disfigurement caused by an accident. This compensation often accompanies accident injury victims who have suffered burns or amputations.
