Getting the Compensation, You Deserve After a Car Accident

A crash can have damaging consequences; even a small or minor motor vehicle accident can result in thousands of dollars in damages, including property damage, injuries, medical expenses, lost wages, pain and suffering, and pain and suffering. Injuries and property damage can be the result of carelessness or negligence of one or many different individuals. For example, a vehicle accident may have been caused by one person, the drivers of two vehicles, or a driver and a city or county that has carelessly maintained a roadway. In some cases, when an accident occurs at a business, the property owner and the business tenant may be responsible for an injury. If a consumer is injured by a defective product, both the manufacture and the seller of the product may incur liability. In some states, the law says that if there is more than one person responsible for any type of injury or accident, either of those persons are responsible for compensating the  injury victim. If one of them pays the entire claim, the law allows them to decide between themselves as to whether the nonpaying party should be reimbursed. This is usually referred to as joint and several liability and while this rule of law can be advantageous for some victims, it is currently abolished in the state of Florida. Instead, the state of Florida has a pure comparative negligence system. This system means that if you were careless and were partly at fault for causing your car accident, you can still recover compensation from anyone else who was also careless or negligent in causing your accident. In a pure comparative negligence system, the amount of a person’s liability or responsibility for injuries is to be determined by comparing their carelessness with the carelessness or negligence of the other persons involved in said accident. It is very important to prove negligence in a car accident case. When you make a good argument to show that the opposing party was negligent in causing your accident, it shows the responsible party’s insurance company that if this case were to go to a lawsuit and proceed further, there’s a great possibility that the court presiding over the case would ultimately find that the insured is legally responsible. If that happens, the insurance company will be required to pay for your damages, court costs, and even attorney’s fees. As you can imagine, that can add up quickly and auto insurance companies are aware of this. Insurance companies are often willing to settle in the pre-trial phase to avoid trial and save quite a bit of money.
