Miami Police Department reported an accident on Northeast 10th Avenue at the intersection of Northeast 82nd Street. According to the statement, a 25-year-old man was struck in the crosswalk along the intersection. The 45-year-old driver of the Ford SUV reportedly drove above the speed limit and was unable to stop at the approaching red light. Then the SUV rear-ended another car, which had stopped for the pedestrian to cross. Subsequently, the SUV pushed the stopped vehicle, which then struck the pedestrian. Upon arrival, first responders found the victim lying unconscious on the road. They stabilized the pedestrian and transported him to a nearby hospital with severe injuries, authorities reported.
Meanwhile, the driver of the rear-ended car also sustained minor injuries, but first responders treated the driver on the scene. The police said they took the SUV driver in for questioning. Police are still investigating the accident and they have not filed charges at the time of reporting.
Pedestrian Car Accident Claims
Serious injuries can happen when a car hits a pedestrian. Some of the more serious injuries include brain injuries, spinal injuries, fractures, lacerations, paralysis, and loss of limbs. Pedestrians who are struck by a car may also suffer other injuries including back injuries, internal organ damage, or other potentially life-threatening injuries. In some instances, pedestrians do not survive the trauma associated with being struck by a motor vehicle.
Even a minor injury can force a trip to the emergency room along with follow-up visits, prescription medication, diagnostic tests, and the like. Serious injuries may require hospitalization, surgeries, or even long-term medical treatment and care. As you can see, pedestrian accidents are scary, and as the population in Florida continues to grow, pedestrian accidents are likely to increase. This is because as the number of cars on the roads continues to increase, so do the number of accidents. When a pedestrian is injured due to someone else’s negligence, a pedestrian can recover damages for the injuries sustained.
You should consult with a personal injury lawyer if you were injured in a pedestrian accident. This is important because many victims of pedestrian accidents are unaware of their rights. Most personal injury lawyers will offer a free evaluation of your pedestrian accident, which is a good thing to take advantage of in case your injuries turn out to be more severe than you initially thought. If your injury attorney thinks you are eligible to file a personal injury lawsuit, you may be able to recover compensation for both monetary and non-monetary damages.
If you are able to prove that the driver who caused your accident was operating their vehicle in a negligent manner, you can recover for your losses. Monetary damages comprise of wages you are unable to earn during your recovery period, medical treatment and medication, surgical procedures, and rehabilitation costs. Non-monetary damages comprise pain and suffering and even punitive damages in some cases. Sadly, not all pedestrians who are hit by a car survive to file a personal injury claim. In these situations, the law in Florida allows for the survivors of the deceased person to file a wrongful death claim against the party who is responsible for the death. A family who has lost a loved one in a pedestrian car accident should contact an injury lawyer for legal advice.
