One Dead After Violent Crash on MacArthur Causeway
One man died after being involved in a violent car crash on the MacArthur Causeway in Miami this past Sunday. The crash occurred early in the morning on Sunday when the driver smashed his car into a guardrail which caused his car to flip over several times before coming to a complete stop on its edge. MDPD closed the MacArthur Causeway as they investigated the scene of the accident. The lanes have since been reopened.
Top Mistakes You Should Never Make After a Car Accident
Not Contacting the Police After a Car Accident: This is one of the biggest mistakes we see drivers make after an accident and it is also one of the most important items on this list. By contacting the police, it allows you to create a record of the damage at the scene and the fault between you and the other driver. This becomes crucial when dealing with insurance companies as they will want proof of the accident and damages at issue in your claim. If you’re involved in an accident and the other driver tries to persuade you to not call the police, don’t fall for it. Oftentimes, the driver will tell you not to worry and will say that their insurance will take care of it. That’s not always the case. Also, remember to review the policy report for any mistakes. Officers are human, and they write hundreds of these reports each year—mistakes happen.
Not Taking Pictures of the Accident: Once you make sure no one is seriously injured and after calling 911, take some time to take detailed pictures of the accident scene with your mobile device or camera if you happen to have one on hand. Make sure to take pictures of the traffic signals, lights, intersection of accident, stop signs, road markings, skid marks, and any other possible obstructions to your view before the accident. Remember, the police are not responsible for doing this and they will not be taking any pictures of the scene.
Waiting Too Long to Obtain Medical Treatment: Many of you may think that you are fine after an accident and decline medical treatment. However, after an accident, you should get checked out to make sure everything really is okay. It is very common to notice pain or soreness long after the accident itself. It could even take days or sometimes weeks after an accident for you to notice an issue. Failure to receive treatment after an accident can be used against by insurance companies to downplay the seriousness of your injuries. Insurance companies will use any delay in treatment against you to de-value your claim. Another worry people have is that it will cost too much to go to the hospital, or, your insurance rates will go up if you get medical treatment. In fact, your PIP insurance covers 80% of your medical bills up to $10,000 (subject to any deductible).
Not Making Use of Your Auto Insurance Medical Coverage: Any injuries that you suffer in an auto accident should be paid under your auto insurance PIP benefits. You can also give your health insurance information to pay for any deductible or co-pays, but auto insurance coverage is primary coverage after an accident, and it should be used.
Attempting to Settle Your Claim Without an Attorney: Insurance adjusters are not on your side. They solely want to protect the interests of their employer—your insurance company. They may tell you that “you don’t need an attorney” and “we can work something out,” but do not be fooled by this. They know that they can settle your case with you for far less, usually thousands of dollars less, than if you had a lawyer advocating on your behalf.
