Determining Liability in Motor Vehicle Accidents

One of the terms you must understand to present your car accident claim is the word  negligence. In overly simplistic terminology, this is the wrong done by the tortfeasor. However, a better understanding of the term will be very useful, as well as  some of the legal concepts behind it, as the concept of negligence is of vital importance  to every claim. The legal definition of negligence involves three parts: (1) a duty, (2) a  breach of that duty, and (3) damage resulting from that breach. Someone who commits  any act which commits each of these three things is negligent. The duty is sometimes  imposed by a law, such as the duty to stop at a red light. In some cases, the duty is less  specific. Generally, every person has a duty to act with care to prevent harming others or  the property of others. This is the legal concept of reasonable care. For example, a  grocery store must use reasonable care to keep grapes and banana peels from piling up  on the floor, and every driver must use reasonable care to avoid colliding with other cars  and pedestrians. The law does not require absolute perfection of a driver or property  owner, just reasonable care. A breach of this duty to use reasonable care occurs when  someone does not use reasonable care. For example, the duty to stop at red lights is  breached when someone drives through the red light while texting on their smart phone.
