Wrongful Death Damages After a Crash

Your life may change in a split second after being in a crash. Unfortunately, car accidents are very common in South Florida. Drivers may be distracted, underestimate the speed of your vehicle, or simply fail to obey traffic signs. There are numerous ways in which car accidents may arise. The most important thing is to be prepared so that if you are caught up in a crash, you can protect yourself and your loved ones. When someone dies as the result of a tort, the lawsuit procedures are a little bit different than in other personal injury cases. A wrongful death case is usually brought by the executor or administrator of the estate of the deceased. That person makes all the litigation decisions as though he or she were the plaintiff. In addition, he or she is responsible to the beneficiaries of the estate for making reasonable decisions. The decisions do not have to be perfect decisions or even the best decisions, but they must be reasonable under the circumstances. Another important difference often applicable to wrongful death cases is how the money is distributed. When a plaintiff dies before his or her case is resolved but does not die because of injuries related to the case, any money that is received normally becomes part of the estate. It is distributed to the beneficiaries according to the deceased’s will—or to his or her legal beneficiaries if he or she had no will. In wrongful death cases in most states, the money does not necessarily go to the same beneficiaries as listed in the will. Instead, most states have statutes indicating to whom the money is to be distributed. Most statutes provide that the money is to be distributed in varying proportions to the surviving spouse, if any; the surviving children, if any; and other relatives if there is no surviving spouse or children. In some states, there is also a provision providing for distribution to others who were economically dependent upon the deceased.
