Traffic Accidents in South Florida

A traffic accident occurs when a person is injured due to someone else’s negligence or carelessness. Traffic accidents are a catastrophic cause of death all around the world. As such, traffic accidents are a key safety concern in Florida producing more than 100,000 crashes and approximately 900 fatalities in 2019. The state of Florida is an unsafe place to drive. Anyone who spends time driving around South Florida will likely agree with that statement. There are many different things that can cause accidents. For example, many accidents in Florida involve out of state drivers or international tourists who come to Florida to visit the theme parks in Orlando or one of Florida’s many beautiful beaches. Unfortunately, in many instances, tourists or out of state drivers are unfamiliar with the traffic laws in Florida and may be lost or disoriented when driving in their rental vehicles from one place to the next. This can often lead to preventable car accidents. Additionally, Florida has a high number of teen drivers. With youth comes inexperience. Young drivers predictably cause accidents because of speed and immaturity. Another common cause of car accident is inclement weather. For example, during the summer, it rains almost every day. People driving in rainy conditions need to drive extra carefully when they drive on wet roadways as they can be held responsible if they fail to drive cautiously under poor weather conditions. In Florida, drivers are expected to use reasonable care while behind the wheel. If you have been injured because another driver was careless, you may be able to obtain damages in a tort lawsuit for negligence. In order to establish a negligence claim, a plaintiff must prove the following elements: duty, breach, causation, and damages. In Florida, all drivers have a duty to act as a reasonable prudent person would under the same or similar circumstances. This certainly extends to drivers that are behind the wheel. A driver is said to have breached that duty when their conduct falls below the standard of care. The first step to receiving money for an injury is proving that the other party was negligent, and their negligence caused your injury. Today, most car accident litigation turns on which driver’s actions were the cause of the accident. In order to establish causation, attorneys must obtain several pieces of information about the accident. Some examples include information on the drivers involved in the crash, eyewitness accounts of the accident, information from police reports, medical records, etc.
