Liability in Car Accident Cases
If there are liability concerns, either because you caused the accident or you can’t prove that someone else did, don’t overlook sources of reimbursement from which you don’t need to establish that someone was at fault. In deciding whether to assert a claim against another driver, remember there is nothing automatic about the obligation of that driver or his insurance company to pay your damages. To recover damages, you must come forward with evidence that the other driver broke the law and that such violation caused the accident and your damages. In most cases, the injured party claims that the other driver was negligent. Negligence is the failure to use reasonable care. It may consist of action or inaction. Negligence is the failure to act as a reasonably careful person would act under the circumstances. If the other person’s negligence was the only cause of the accident, that person is completely at fault and must pay 100% of the damages. However, more than one person may be at fault. The other person may claim that you were at fault or partly at fault. The other person may claim that some third party was at fault or that you and some third party were at fault. In determining who pays for your damages, fault is generally apportioned between or among the persons whose negligence caused the accident. In most states, you may be partly at fault for the accident and nonetheless recover damages. However, your recovery will be reduced in an amount that reflects your comparative fault.
