What is the statute of limitations for a car accident case in Florida? A statute of limitations is a specific time period in which a person may bring a claim against another. The filing requirements and deadlines vary from state to state. In the state of Florida, the statute of limitation is found in Fla. Stat. § 95.11(3)(a) and provides that a claimant has four years to sue for any personal injury arising from a car accident in Florida. After the statute of limitations has expired, it is extremely difficult to file a lawsuit against the other party to your car wreck to recover compensation for your injuries.

What are the different types of compensation I can obtain after a car crash? After a car crash, there are many different types of compensation that can be obtained including medical expenses, costs of medical procedures and surgeries, lost wages, pain and suffering, vehicle repair or replacement costs, etc.

How do you determine the value of a personal injury claim? Sadly, there is no standard formula that magically determines the exact value of every personal injury claim. Instead, numerous factors are considered to determine the potential compensation that one may obtain after a car accident including the amount of medical bills that you have incurred as a result of your medical treatment for your injury, whether your injury is permanent in nature, and whether you were in any way at fault for causing your injury.

Will I have to go to court after filing a car accident claim? It depends. Most parties in a car accident lawsuit are unfamiliar with the process of filing a personal injury lawsuit or filing an insurance claim for that matter. In most cases, however, car accident cases are settled before ever going to trial. In some instances, however, auto insurers are unwilling to settle for a fair amount, and a case must move forward to trial. If your case does progress to the trial stage, don’t worry–our legal team prepares every car accident claim as if it will go to trial, so we are never caught off guard if the case progresses to that stage of litigation.
