A Miami Lakes woman has been killed in a crash between four cars last night in Miami Lakes near NW 37TH Avenue. A preliminary investigation revealed that a 2019 Toyota broke down and pulled over to the side of the highway around noon. Two other cars, a 2015 Chevrolet Camaro driven by a 27-year-old male and a 2020 Nissan Altima driven by an elderly woman pulled over behind the Toyota to wait for a tow truck. A 2010 Ford F-150 Truck drove onto the shoulder and crashed into the Nissan, causing it to bump into the Camaro, which then hit the Toyota. The driver of the ford truck was taken to the hospital with non-life-threatening injuries. Sadly, the driver of the Nissan died at the scene of the accident. Police do no suspect alcohol or drug use was a factor in the crash. No charges have been brought against the driver.
Stages of a Personal Injury Claim
Pre-Litigation Stage: The legal process is separated into two basic categories: pre suit and litigation. Pre suit is short for pre lawsuit. During the pre-lawsuit stage, you will be treated by doctors and will focus on recovering from the injuries you sustained in the accident. Meanwhile, your attorney will be gathering your medical bills and your medical records to get a good sense of what your injuries are. At this point, a demand will be made to the insurance company of the person who caused the accident. If the insurance company does not want to pay what your claim is worth, you will have the decision whether to go on to the next stage and file a personal injury lawsuit.
Filing a Personal Injury Lawsuit: Once you give your attorney authorization file a lawsuit, your attorney will file a complaint which details how your accident happened and how you were injured. the other side will have the opportunity to respond.
Discovery: answer in the case we move into the disk you will have to answer written questions under oath will have to provide your medical records or medical bills to the other side and then you will be able to find out from the other side documents that they may have and also ask them written questions to be answered over you will probably have your deposition taken which is when you go to a court reporter’s office and you sit down and you give testimony under oath and then your attorney will have the same opportunity to depose the person that caused the accident
Mediation: After discovery, we will try to reach a settlement. If no settlement is reached, the court may order a mediation.
Trial: if we can’t settle your case, you can choose to go to trial. At trial, a jury will determine whether or not the person that hit you or caused the accident whether or not you were injured and what the extent of your injuries are and they will also determine whether or not you will need future treatment all of that will be put down into a verdict that the jury foreperson will assign and at that point your verdict will be then transferred into a judgment which says that you were able to prove your case so now that you have a general idea the next steps that your case would take if you decide to have an accident attorney maybe you feel more comfortable to make that call today
