Factors Affecting Car Crash Injury Claims
For any type of accident, there are many factors that determine the success of the case. It is especially important if you want to know who is at fault for the accident, who will pay the medical bills, and what is the value of the claim. Below is a short list of some of the factors that determine the success of most personal injury claims related to car accidents.
Level of injury: the severity of your injury is the most important factor in determining the total amount or value of your claim. Any injuries that incapacitate you and make you unable to perform your daily duties will warrant wage loss claims. In some instances, you may need a competent lawyer to help you defend your claims because most insurance companies will try their best to undermine any wage loss claims you assert. This is because wage loss claims can become extremely expensive to pay out for insurance companies.
Damage to Your Car: In most accidents, a badly damaged car increases the likelihood of a higher payment in compensation. This is since severe damage is associated with the potential for greater injury, as opposed to that of a car which has only minor damages.
Liability Issues: In some personal injury cases, the insurance company may claim that you were at fault for your injury. If liability is in question, you can be sure that an insurance company will look to push forward with litigation.
Pre-Existing Injuries: The next thing you need to be aware of is when an insurance company tries to make it seem like the injury you sustained in your accident or fall, occurred either prior to the event at issue or was a pre-existing injury. This is insurance talk that basically means that the insurance company and their adjuster don’t believe that they are responsible for your injury because you were already injured before your accident.
