Dog Bites Woman, Neighbors Say Attack is Not the First

According to a police report, a dog injured a woman and her smaller dog when he attacked her as she was walking her small dog along NW 30th Avenue just off State Road 816 in the Wilton Manors community located slightly north of Fort Lauderdale. According to a spokesperson for Miami-Dade Police, the woman was attacked when the larger canine ran through an open gate and lunged at the woman who was holding the smaller dog in her arms to protect it. According to several neighbors, this is not the first time this particular dog attacks a person or other animal. There is footage posted online that shows that some good samaritans tried to intervene and get the larger dog to pry the smaller dog free. No further details were released.

Florida Dog Bite Injury Laws

Vicious dogs on the loose are a threat to neighbors, young children, and all adults. Thankfully, for dog bite victims, the laws in the state of Florida are quite generous. Specifically, under Florida law, a dog bite victim may sue a dog owner based upon statutory strict liability, negligence, negligence per se, or intentional tort. Florida law says that the owner of a dog who bites another individual in a public place or lawfully in a private place will be held strictly liable for injuries resulting from the dog bite. On the other hand, an individual that gets injured by a dog in some other manner, needs to prove that the owner was negligent or otherwise failed to use reasonable care resulting in the injury. Essentially, Florida is a strict liability state as it pertains to liability for dog bite injuries. This means that even in cases where the owner has no prior knowledge of their dog’s propensity to bite or be violent, the owner will still be liable for damages to an injured individual.
