SUV Rolls Over in Multi-Car Accident in Oakland Park, Leaves One Dead and Two Injured

The Broward County Police Department is investigating an early morning crash that left one dead and two seriously injured in Oakland Park. Fire Rescue units responded to the three-car crash along North Dixie Highway and East Commercial Boulevard on Thursday. The police department says two persons from one of the cars in the accident had to be extracted from their vehicle and airlifted to the hospital. The accident temporarily forced the southbound lanes of North Dixie Highway to shut down, but the roadway has since reopened. An officer pointed out that one of the large pieces of debris sitting at the intersection was an engine from one of the cars. The Broward Police Department is still investigating the accident. No further information by the victims had been made public. At Suarez & Montero Car Accident Lawyers, we believe that traffic deaths and serious injuries are preventable and unacceptable. For us, the only acceptable highway safety goal should be zero serious injuries and fatalities.

What Happens if You Were Injured and the Insurance Provider Won’t Pay?

Florida’s no-fault insurance law was originally passed in the 1970s, with the purpose of providing individuals with rapid access to funds to assist with their recovery after being injured in a car crash and alleviate the burden of personal injury lawsuits on Florida court dockets. Nevertheless, many victims of car accidents find that their insurance company is oftentimes reluctant to pay for all of their injuries and compensate them for all of their medical expenses. If you have been injured in a car accident and your insurance carrier won’t pay, an experienced personal injury attorney may be able to help you.

What Is PIP and How Does it Work?

Everyone who registers a vehicle in Florida is required to have at least $10,000 of Personal Injury Protection (PIP) coverage. This is known as nofault insurance. Personal Injury Protection (PIP) covers medical expenses, lost wages, and death benefits, those living in the household of the insured, and those traveling in the insured’s car who do not have a PIP policy of their own. PIP policies cover up to 80 percent of qualified medical expenses up to the limit of the policy, including:

• Surgery Costs

• Medical services

• Ambulatory costs

• Rehabilitation services

• Medications

• Hospital expenses

• Diagnostic services

Additionally, PIP policies also cover up to 60 percent of lost wages and up to $5,000 for funeral and burial expenses. However, there are some limitations and items that your personal injury protection coverage will not cover including property damage to your vehicle and injuries suffered to the occupants of the other vehicle. PIP insurance benefits are generally due in the first 30 days after your insurance company is notified of your accident.

While you may think your insurance, company works for you and is on your side, the truth is that car insurance companies are in the business of making money. Their goal is to increase profits and one of the ways they do this is by denying claims and underpaying claims. There are several reasons that may cause your auto insurance company to deny your PIP claims including:

• Failure to obtain initial medical care within 14 days after the car accident

• Failure to file claim within a timely manner

• Medical treatment or services were not lawfully ordered, provided, and supervised by a licensed physician, dentist, or emergency transportation or treatment provider, or in a hospital or a facility owned by a hospital

• No follow-up treatment was provided through a referral from a licensed provider or was not consistent with the underlying medical diagnosis

• Claim is found to be fraudulent

• Injuries sustained were the result of a pre-existing condition

. • Insured is found to have been driving under the influence at the time of the accident.

• Insured is seeking coverage for treatments from a massage or acupuncture therapist. Massage and acupuncture are not covered by PIP policies
